The New York City Department of Environmental Protection (DEP) protects public health and the environment by supplying clean drinking water, collecting and treating wastewater, and reducing air, noise, and hazardous materials pollution. DEP is the largest combined municipal water and wastewater utility in the country, with nearly 6,000 employees. We delivers more than 1.1 billion gallons of high quality drinking water per day to 8.5 million New York City residents and more than 1 million people in Upstate New York, and has a wastewater conveyance and treatment system capable of processing over 1.3 billion gallons of wastewater per day to protect the environment and the city's surrounding waterways.

The Office of Engineering Audits (OEA) independently audits vouchers for payment of construction, expense and construction-related services contracts to ensure that the City has received appropriate value for the work performed. The OEA was established pursuant to Section 93(h) of the City Charter, which delegates the Comptroller’s authority for pre-payment audit of vouchers to the agencies, and Comptrollers Directive 7 which requires that each agency that frequently lets contracts for construction, equipment, and construction related services appoint an Engineering Audit Officer (EAO) to carry out this auditing responsibility. The function of OEA is, therefore, mandated by the City Charter. Directive 7 further requires that the EAO report directly to the agency head, or to a deputy agency head and, to preserve the EAO's independence and the integrity of the audit process, the EAO's duties must be fully segregated from any related operational responsibilities. The OEA consists of five units: Construction Payments, Consultant Payments, Expense Payments, Change Orders, and Administrative, with a staff of engineers, accountants and administrative personnel.

This position as First Deputy Director supervises and directs the activities of the Deputy Directors and Assistant Deputy Directors responsible for all change orders reviews, construction-related payment requisitions and Job Order Contracting (JOC) payment requisitions, in addition to being responsible for all associated staff of engineers and accountants in performing audits for payments on major capital, consultant and expense construction and construction related contracts. Also, supervises engineers in reviewing the acceptability of contract changes, consistent with established agency and City policies and directives. Researches and develops long range policy regarding the performance of contract compliance audits, including those for complex major capital projects. Resolves complex auditing problem dealing with the Department’s capital program. Assists under the direction of the Director in the formation of agency wide policy as it relates to auditing and engineering. Consults with public and private organizations in the development of audit contracts.

Provides clear direction to a diversified, multi-disciplined staff with extremely complex staff functions with clear agency-wide impact while implementing agency-wide policy and goals, such as interpretation of the Standard Construction Contract (SCC), PPB Rules and City Charter. Acts as agency liaison with owners, partners and principles of contracting and consulting firms. Responsible for review and approval of capital and expense payment requests to the magnitude of $2.5 Billion and review and approval of change orders to the magnitude of $500 Million. Generally, oversees major functions which are of critical importance to agency operations such as overseeing very complex and technically complex engineering projects. Prepare and present to the Director including upper senior management reports and key Performance Indicators (KPI) significant to the agency’s fiscal impact. Technical advisor to the Director on Technically complex matters related to engineering audits. Also preform studies, researches, and other tasks of a complex and/or confidential nature, as issued by the Director and senior management. Represent Agency and the Commissioner before New York City Comptroller’s Office regarding dispute resolutions, delay claims and other pertinent complex engineering matters concerning interpretation of contract language as it pertains to the Standard Construction Contract. Coordinate with the Mayor’s Office of Construction, Consultants, and Contractors for successful resolution of complex engineering matters relating to Multi-million in value of payments and contract change orders. Assist the Director in establishing and issuing guidelines to be utilized throughout the Agency as it relates to payments, change orders and overseeing and ensuring compliance with such guidelines. Assist the Director in overseeing overhead audits of consultant firms to ensure audited rates are reasonable and in compliance with NYC Comptroller’s Directives and contract provisions and pursue and recoup any overpayments as a result of such overhead audits. In addition, overseeing all construction and related construction auditing matters. Acts on the behalf of the Director in his absence and representing him in meetings with senior upper management, at the Comptroller's Office, or other government agencies.

Qualifications

  1. A valid New York State License as a Professional Engineer and six (6) years of full-time satisfactory experience in chemical engineering, civil engineering, electrical engineering, environmental engineering, mechanical engineering, or plan examining work, at least two (2) years of which must have been in an executive, managerial, or administrative capacity.
